LEGAL DRAMA: Raphael Tuju SEEKS ANTICIPATORY BAIL OVER ‘ARREST THREATS’

Former Cabinet Secretary Raphael Tuju has moved to the High Court seeking anticipatory bail, claiming he is under constant threat of arrest and harassment by state agencies.

In an urgent ex-parte application, Tuju alleges that on March 21, he was trailed by unmarked vehicles, forcing him to abandon his car and seek refuge at a secure location over fears for his safety.

 

Claims of Harassment and Assault

According to court documents, Tuju later presented himself at Karen Police Station to record a statement. However, he claims the situation escalated when officers allegedly manhandled him, worsening injuries he sustained in a previous airplane and road accident.

His legal team argues that the actions of law enforcement agencies amount to intimidation and abuse of power, raising concerns over due process.

 

Hospitalisation Under Police Watch

Tuju was on Tuesday transferred to Karen Hospital, where he remains under continuous police guard, despite not being formally charged.

He now wants the court to declare the move unlawful and inhumane, stating that being held under custodial watch in a hospital violates his:

  • Right to liberty
  • Right to dignity
  • Right to access medical care without interference

 

Orders Sought from Court

In his application, Tuju is seeking orders to restrain:

  • The National Police Service
  • The Directorate of Criminal Investigations
  • The Office of the Director of Public Prosecutions

from summoning, arresting, or interfering with his freedom of movement.

He is also asking the court to guarantee that he can continue receiving medical treatment without intimidation or police presence.

 

Willing to Cooperate

Despite the standoff, Tuju maintains he is a law-abiding citizen ready to cooperate with investigators — but only within the bounds of the law.

“In the event the applicant is granted bail, he is willing to appear in court or before police once summoned,” court papers state.
